 - Publication of deposit LDP

The Habitats Regulations Assessment is required by Sections 85A-E of the Conservation (Natural Habitats and c.) Regulations 1994 (as amended 2007) to ensure that key international nature conservation sites are safeguarded and that the plan will not cause significant negative effects on them.  If it is determined that the LDP is likely to have significant negative effects on European sites, a more detailed HRA will be required.


Preliminary screening report – November 2009

A Preliminary Screening Report has been prepared and this completes the first part of the HRA process by providing a constraints plan to inform and support the LDP Preferred Strategy.

The Preliminary Screening Report includes:

l the identification of protected areas;

l the identification of the qualifying feature(s) for each protected area; and

l the setting out of likely constraints associated with the policies in the Preferred Strategy of the LDP;

l the setting out of the potential impacts of the Preferred Strategy on the Natura 2000; 

l the providing of a list of those areas that require taking forward to the next stage of the HRA process and those that require no further HRA work;

l recommendations for amendments to avoid significant adverse effects on European Sites.

The Preliminary Screening Report is now available in the Downloads section to the right. Comments were invited on the HRA Preliminary Screening Report as part of the wider consultation on the Authority’s pre deposit proposals documents. Comments were received by the Council from the 4 November 2009 to the 4 January 2010.

It will be useful to view to HRA Report in conjunction with the Pre-Deposit Preferred Strategy as the two documents are closely interlinked.

This document was reported to County Council Executive Board on the 22 March 2010 and was reported to full Council on the 22 April 2010.
